If you’re concerned about an employee’s behaviour, what exactly can you do?
Suspicious behaviour might indicate that an employee is moonlighting, that they’re faking an illness to get time off work, or that they’re sharing information with a competitor, amongst a whole host of other possibilities.
Did you know that you’re not allowed, by law, to read an employee’s personal correspondence? This includes emails and messages that they send out using business accounts. You can check email addresses and email subject lines, but not the content within. You are allowed to monitor your employees using CCTV, but only in certain places.
It’s important to be careful when monitoring employees
Your employee handbook, or an employee’s contract, should explain what you’re able to monitor and why. You need to be as clear as possible about how you’re monitoring your workers. Anything that you record whilst monitoring an employee must also be stored in accordance with the Data Protection Act.
It’s all a bit complicated. You have to be very careful, but it’s understandable that you’d want to keep an eye on what your employees are doing. You don’t want to pay someone to collect and give away all of your trade secrets, nor do you want to pay someone that’s claiming to be ill whilst working for someone else.
