Process serving is the act of delivering legal documents to an intended recipient by hand. There are a number of examples of legal papers that must be delivered in this way, rather than simply posted to the recipient. These include divorce petitions, court orders, injunctions and bankruptcy petitions, and many more.
Technically, as process serving is unregulated, anyone is allowed to serve documents to a recipient, just as long as they aren’t directly involved in the case. Yet it makes much more sense to use an experienced process server who you know to be reliable, and who can deliver the documents in a timely manner without costing you the earth.
This is where using a private detective begins to make more sense. A trained detective will know all about the rules of process serving, including how to provide the required evidence that documents have been served. Not only that, but a private detective can make the actual process serving run much more efficiently, as they’re more likely to be able to track down a recipient with ease.
This is especially useful when the recipient is being evasive. Sometimes a person will try to avoid receiving documents, if for instance they don’t want to go to court and know that without the summons, they have an excuse. Employ a private detective though, and you’re much more likely to trace the recipient, even if they’ve moved to a new town, so that court summons or indeed any document is delivered by the required date. Use any other process server and they’re more likely to give up once they struggle to find the recipient in the first instance.
